Sam Benkman-Fried’s lawyers have said they have filed a new request for his temporary release or to be allowed to meet with his legal team five days a week to prepare his defense.
Bankman’s lawyers have argued that Bankman’s right to self-defense has been violated because he is in jail and the documents he needs to review are only available online.
The letter from Bankman’s lawyers states: “In our opinion, nothing but Bankman’s temporary release can solve the existing problems and protect his right to defend himself. We ask the court to reconsider its previous decision and order that Mr. Benkman be brought to our proposed location at 500 Pearl Street for five days a week. He should also be allowed to use a laptop with internet connection so that he can review and edit documents with his lawyers. Defense personnel will be present next to Mr. Benkman and will take the laptop from him at the end of the meeting.
It should be mentioned that the judge of the court had recently revoked Bankman’s bail for some reasons. His lawyers have now appealed and are trying to keep him out of custody. They wrote in their letter that Bankman needs a laptop so that he can review the available documents through the Internet and share them with his lawyers.
Of course, Benkman currently has access to a laptop, but he can only use it for six hours a day, two days a week, which is very little. Bankman’s current laptop has limited battery life and a poor internet connection, his lawyers said in the letter.
According to Benkman’s lawyers, according to the sixth amendment of the US Constitution, he has the right to participate in the preparation of the defense and receive assistance from his lawyers.
