Poland’s good service to the Zionists; Dehnkeji “Warsaw” to the International Criminal Court – Mehr News agency RCO News Agency
Mehr News Agency, International Group: On November 21, 2024, the International Criminal Court issued an arrest warrant for Benjamin Netanyahu, the Prime Minister, and Yoav Galant, the former Minister of War of the Zionist regime. During this period, many countries announced that they will execute the court’s arrest warrant if the Zionist authorities enter; In the meantime, Poland recently announced that it will not implement the judgment of the court and has no decision to arrest Netanyahu.
Poland’s support for the Zionist regime after October 7
After October 7, 2023, Poland is one of the most important supporters of the Zionist regime among European countries. Relations between the two sides have been ongoing since September 1948. During this period, Poland is one of the economic, technological, cultural and foreign policy partners of the occupying regime. Tel Aviv’s direct investment in Poland is estimated at 3-5 billion euros. In 2017, the former head of the Zionist regime, Reuven Rivlin, called the regime’s contact with the European Union and Poland the core of Tel Aviv’s foreign policy. Poland’s approach in supporting the occupying regime after October 7 is important from two dimensions:
1. In the meeting with the Zionists, the Polish authorities have emphasized statements such as “cooperation with Tel Aviv in the fight against terrorism” and “thousand-year historical and cultural ties between the two sides.” Poland’s special envoy in Tel Aviv said in an interview with the Times newspaper of the Zionist regime at the same time as the October 7 operation: “The whole democratic world should support Israel (regime) in the fight against terrorists.” He also rejected the accusations about the occupation regime’s genocide in Gaza and said: “I am absolutely sure that the Israeli army (regime) is not planning an operation to kill innocent people.”
2. For more than a year, Poland has been trying to promote Tel Aviv’s support position in the European Union. This country in the Union has always emphasized the right of the Zionist regime to do anything to preserve its existence and ensure the security of its citizens inside and outside.
Poland’s approach to the judgment of the International Criminal Court
After the arrest warrant issued by the Zionist authorities, the leading Polish newspaper Rzeczpospolita reported that Netanyahu is not going to participate in the liberation ceremony of the German-Nazi Auschwitz camp, which will be held in Poland on January 27, due to fear of arrest. But recently, Polish President Andriy Duda asked Prime Minister Donald Tusk to guarantee that Netanyahu will not be arrested by the International Criminal Court for traveling to Poland to participate in the ceremony. The news of this letter was first reported by Bloomberg. The president of Poland has used the tradition of legal protection of foreign missions as an excuse for Netanyahu’s entry.
“He trusts that the government can use the rich traditions in the field of legal protection of foreign delegations entering Poland to find an appropriate formula for the above-mentioned guarantees and reconcile respect for international law with the extraordinary nature of international law,” Duda said.
Although some officials, such as the Deputy Foreign Minister of Poland, have emphasized the country’s duty to respect the sentence of the Criminal Court, but it seems that this approach is mostly due to the relationship between the President of Poland and the President-elect of the United States, Donald Trump, because Duda as a person The conservative has close ties to Donald Trump, while Tusk is a more liberal figure who also has a track record of criticizing Trump.
Ignoring human rights
Before the establishment of the International Criminal Court, which takes steps to try people who commit the most heinous international crimes regardless of the immunity and status of the accused, without a doubt, few could have imagined that it would be possible to implement justice for high-ranking officials in a world centered on sovereignty. The establishment of the International Criminal Court has opened another way to protect human rights and prevent their violations in the world. This court has jurisdiction over crimes such as crimes against humanity, war crimes and genocide. In this situation, it seems that Poland’s approach in ignoring the verdict of the Criminal Court strengthens the suspicion that human rights and international laws are only a tool to serve the interests of the United States, European governments and their allies.
Conflict with the bindingness of the judgments of the International Criminal Court
On the other hand, Poland’s approach is in conflict with the binding nature of the judgment of the International Criminal Court. This is while The decisions of the court are binding for all countries. Based on voluntary rights, the decisions of the Court are binding on the contracting parties, in the form of the Statute of the Court and the Charter of the United Nations.
Palestine has jurisdiction of the International Criminal Court since the 12th of June 2014 accepted In this regard, the annexation of Palestine to this document makes it possible to prosecute and try the perpetrators of crimes under the jurisdiction of the court in Palestine. In the current war, which has been going on in Gaza since 2023, the exercise of jurisdiction of the court compared to the actions of the Zionist regime is more compatible with the principles and goals of the establishment of the court, and in this regard, the court, after a long investigation, ordered the arrest of two senior officials of the occupying regime. He has committed war crimes and crimes against humanity in Gaza. In this situation, Poland, along with other members of the court, is obliged to arrest the couple if they enter its territory.
the result
Poland’s support to the Zionist regime has increased after October 7, 2023. Poland’s latest protective measure is the declaration of non-implementation of the International Criminal Court’s order to arrest Netanyahu. Ignoring this ruling can be considered as a sign of Warsaw’s disregard for human rights and the judgments of the International Criminal Court under false pretenses.
This approach has faced many criticisms. Piotr Hofmanski, the former head of the International Criminal Court, stated that from a legal point of view, the issue is completely clear; There is a warrant for the arrest of the Prime Minister (regime) of Israel for committing war crimes, and governments are obliged to implement it. This decision of Poland is completely political. Ignoring the legal and international obligation to fully cooperate with the Court will undermine Poland’s international position. This approach will question the philosophy of the existence of the International Criminal Court if the governments refuse to fulfill its obligations.
